Terms of Service

Account Registration

• You must be at least 18 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining account security
• One person may not maintain multiple accounts without our written approval

Professional Accounts

• Must pass any required background or identity verification
• Must provide valid business, tax, and payout information
• Must maintain required licenses, permits, and insurance where applicable
• Must comply with the Professional Agreement and applicable Stripe connected account requirements
• Are subject to ongoing performance, trust, and compliance monitoring

Prohibited Activities

• Fraudulent, deceptive, or misleading conduct
• Harassment, discrimination, or inappropriate behavior
• Circumventing platform subscriptions, payment systems, or platform safeguards
• Sharing contact information to move transactions off-platform in violation of platform rules
• Creating fake accounts or impersonating others
• Uploading inappropriate, unlawful, or infringing content

Service Standards

• Provide services as described and advertised
• Maintain professional standards and conduct
• Respect client property and privacy
• Comply with all applicable laws and regulations

Subscription Model

• Clients: $1/month for the first 3 months, then $5/month
• Professionals: $1/month for the first 3 months, then $10/month
• Subscriptions auto-renew monthly until cancelled. After the 3-month introductory period ends, the full monthly rate applies automatically.
• The Beauloom current platform revenue comes from recurring subscriptions, not commissions on individual bookings
• Beauloom does not currently charge a booking commission or application fee on service payments
• Subscriptions can be cancelled at any time from Settings; access continues until the end of the current billing period

Client Payments

• Beauloom facilitates card payments through Stripe Connect when a booking is paid online
• Service proceeds are routed to the professional connected Stripe account, less Stripe fees and any payment adjustments required by Stripe or the card networks
• Refunds and cancellations are governed by the posted professional policy, these Terms, the Professional Agreement, applicable law, and payment processor rules
• Beauloom may review complaints and may operationally process refunds, reversals, or other adjustments when required by Stripe, card-network rules, law, or platform safety policies

Professional Payouts

• Beauloom does not currently deduct a booking commission or application fee from service payments
• Payment processing fees, refunds, chargebacks, dispute fees, reserves, or other Stripe adjustments may still reduce or reverse booking-related amounts
• Payouts are processed according to your Stripe connected account and payout schedule
• Professionals remain responsible for the services they provide, including taxes, cancellations, refunds, chargebacks, and disputes arising from their services

Platform Liability

Beauloom acts as a technology platform connecting clients and professionals. We do not guarantee the quality, safety, timing, legality, or outcome of services offered by professionals, and our liability is limited to the maximum extent permitted by law.

Professional Responsibility

Professionals are independent contractors responsible for their own actions, service delivery, refund and cancellation commitments, insurance coverage, taxes, and compliance with applicable laws and regulations.

Health and Safety Disclaimer

Beauty services involve direct physical contact and the use of cosmetic products that may cause allergic reactions or skin irritation. Beauloom does not provide medical advice and is not responsible for adverse reactions to services booked through the platform. Clients should disclose allergies, skin conditions, and medical concerns to their service provider before any treatment. Professionals are responsible for conducting appropriate consultations and patch tests.

Anti-Discrimination

All users must comply with applicable anti-discrimination laws. Professionals may not refuse service based on race, color, national origin, religion, sex, gender identity, sexual orientation, age, disability, marital status, or any other characteristic protected by law. Clients may not discriminate against professionals on these bases. Violations may result in account termination.

Indemnification

You agree to indemnify, defend, and hold harmless Beauloom, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys fees) arising out of or related to: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) services you provide or receive through the platform.

Account Termination

• Either party may terminate an account at any time
• We may suspend or terminate accounts for policy violations, legal risk, or payment risk
• Outstanding bookings, refunds, disputes, chargebacks, taxes, and payment obligations will be handled according to our policies and any applicable professional agreement
• Some provisions of these Terms survive account termination

Platform Disputes

Disputes related to services, payments, or platform usage should first be reported through our customer support channels. Beauloom may investigate complaints, request evidence, and offer non-binding intake or mediation support, but Beauloom is not obligated to adjudicate every dispute or guarantee a particular outcome.

Nothing in this section limits the Beauloom ability to issue refunds, reverse transactions, suspend accounts, comply with Stripe or card-network rules, or take platform safety actions when required by law or our policies.

Binding Arbitration

Any dispute arising from these Terms or your use of the platform shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. There is no judge or jury in arbitration, and court review of an arbitration award is limited.

Class Action Waiver: All claims must be brought in your individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.

Opt-Out: You may opt out of this arbitration provision by sending written notice to legal@beauloom.app within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the state or federal courts located in the State of Florida.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
