Professional Agreement

Terms that apply specifically to beauty professionals using Beauloom.

Who This Applies To

This Professional Agreement applies to every user who creates, maintains, or uses a professional account on Beauloom. It supplements the Beauloom Terms of Service, Privacy Policy, Refund Policy, Content Policy, and any additional platform policies we publish from time to time.

By creating or using a professional account, you agree to this Professional Agreement. If there is a conflict between this Agreement and the general Terms of Service on a professional-specific issue, this Agreement controls for that issue.

1. Platform Role and Independent Contractor Status

  • You are an independent contractor and not an employee, agent, joint venturer, franchisee, or partner of Beauloom
  • You are the provider of the beauty services you list and perform on the platform
  • You are solely responsible for how you advertise, price, schedule, perform, and complete your services
  • Beauloom provides software, subscription access, trust and safety tooling, and payment facilitation, but does not supervise or control your day-to-day work
  • Beauloom does not guarantee leads, bookings, revenue, client demand, or any minimum level of business activity

2. Subscription Access and Listing Rights

  • Your access to certain professional features may require an active paid subscription or trial
  • Your subscription fee buys access to the Beauloom software platform and related professional tools; it is not a purchase of guaranteed bookings
  • The Beauloom current monetary gain from professional accounts comes from monthly subscriptions rather than per-booking commissions
  • Beauloom may change, suspend, or retire professional features in accordance with the Terms of Service

3. Licenses, Insurance, Taxes, and Compliance

You are solely responsible for understanding and complying with the laws that apply to your services and your business. This includes laws relating to cosmetology, esthetics, barbering, sanitation, advertising, home services, zoning, consumer protection, and tax reporting.

  • Maintain all licenses, permits, registrations, and certifications required for your services
  • Maintain any insurance required by law or reasonably expected for your type of work
  • Determine, collect, report, and remit any applicable sales, use, income, self-employment, or other taxes
  • Maintain accurate books and records for your services and transactions
  • Provide truthful tax and business information to Beauloom and Stripe when requested

4. Bookings, Cancellations, Refunds, Disputes, and Chargebacks

You are responsible for your service-related obligations to clients. This includes accurately communicating your availability, service scope, preparation requirements, location details, timing, cancellation policy, and refund expectations.

  • You are solely responsible for cancellations, refunds, re-performance requests, complaints, and disputes arising from your services
  • You must honor the cancellation and refund terms you publish on Beauloom, subject to applicable law and processor rules
  • You must cooperate promptly with any Beauloom or Stripe request for evidence, documents, photos, messages, timelines, or other dispute-related information
  • You authorize Beauloom to assist with or operationally process refunds, reversals, or dispute responses when required by payment processor rules, card-network rules, law, or platform safety policies
  • Beauloom may suspend listings, limit account functionality, or remove you from the platform if repeated cancellations, complaints, or disputes create trust, safety, legal, or payment risk

5. Stripe Connect and Payout Accounts

Online booking payments on Beauloom are facilitated through Stripe Connect. To receive online payments, you must maintain a connected Stripe account in good standing and comply with the Stripe applicable connected account, services, and tax terms.

  • You must provide complete, accurate, and current payout, identity, and tax information
  • You authorize Beauloom to share necessary information with Stripe and related service providers to onboard, verify, pay, or review your account
  • Beauloom does not currently deduct a booking commission or application fee from service payments
  • Stripe processing fees, refunds, chargebacks, dispute fees, reserves, reversals, or other processor adjustments may still reduce or reverse booking-related amounts
  • If your Stripe account becomes restricted, disabled, or unable to accept charges or payouts, Beauloom may limit your platform activity until the issue is resolved

6. Reimbursement, Setoff, and Loss Allocation

If Beauloom, Stripe, or a card network incurs losses, refunds, reversals, chargebacks, dispute fees, fines, penalties, assessment costs, legal expenses, or other amounts attributable to your services, your conduct, your policy violations, or your legal noncompliance, you are responsible for reimbursing Beauloom for those amounts to the extent permitted by law.

  • Beauloom may invoice you directly for amounts you owe
  • Beauloom may set off or recoup amounts owed against other amounts payable to you, if any, to the extent permitted by law and by the payment flow in use at the time
  • Your reimbursement obligation survives account suspension, cancellation, and termination

7. Accuracy, Communications, and Client Treatment

  • All service descriptions, prices, credentials, photos, and portfolio content must be truthful and current
  • You must communicate professionally and respond to time-sensitive booking issues in a commercially reasonable manner
  • You may not discriminate against clients or engage in harassment, retaliation, fraud, or abusive conduct
  • You may not ask Beauloom to misstate refund outcomes, dispute facts, or regulatory information on your behalf

8. Suspension and Termination

Beauloom may suspend, restrict, or terminate your professional account if we believe your conduct creates legal, safety, reputational, processor, or operational risk, including repeated cancellations, payment disputes, unlicensed activity, failure to maintain Stripe eligibility, or material breach of this Agreement.

Suspension or termination does not relieve you of any outstanding obligations, including reimbursement, indemnity, tax, refund, dispute, chargeback, or record-keeping obligations.

9. Indemnity and Incorporated Dispute Terms

In addition to the indemnity obligations in the Terms of Service, you agree to indemnify and hold Beauloom harmless from claims, losses, expenses, and liabilities arising from your services, your legal noncompliance, inaccurate profile or pricing information, cancellation or refund practices, taxes, or disputes with clients or regulators.

The arbitration, class action waiver, governing law, and dispute-resolution provisions in the Terms of Service are incorporated into this Agreement and apply to the fullest extent permitted by law.
